This book addresses key conceptual issues relating to the modern scientific and engineering use of computer simulations. It analyses a broad set of questions, from the nature of computer simulations to their epistemological power, including the many scientific, social and ethics implications of using computer simulations. The book is written in an easily accessible narrative, one that weaves together philosophical questions and scientific technicalities. This article aims to develop a new account of scientific explanation for computer simulations. To this end, two questions are answered: what is the explanatory relation for computer simulations? And what kind of epistemic gain should be expected? For several reasons tailored to the benefits and needs of computer simulations, these questions are better answered within the unificationist model of scientific explanation. Unlike previous efforts in the literature, I submit that the explanatory relation is between the simulation model and the (...) results of the simulation. This article asks the question, ``what is reliable machine learning?'' As I intend to answer it, this is a question about epistemic justification. Reliable machine learning gives justification for believing its output. Current approaches to reliability (e.g., transparency) involve showing the inner workings of an algorithm (functions, variables, etc.) and how they render outputs. We then have justification for believing the output because we know how it was computed. Thus, justification is contingent on what can be shown about the algorithm, (...) its properties, and its behavior. In this paper, I defend computational reliabilism (CR). CR is a computationally-inspired off-shoot of process reliabilism that does not require showing the inner workings of an algorithm. CR credits reliability to machine learning by identifying reliability indicators external to the algorithm (validation methods, knowledge-based integration, etc.). Thus, we have justification for believing the output of machine learning when we have identified the appropriate reliability indicators. CR is advanced as a more suitable epistemology for machine learning. The main goal of this article is to lay the groundwork for CR, how it works, and what we can expect as a justificatory framework for reliable machine learning. (shrink)

This study critically explores, in the light of Christian theology, the singular inter- pretation that François Laruelle (1937) makes of the figure of Christ and his relation- ship with human being. First, we approach the way in which Laruelle’s Christology challenges the abidance between the apostolic narrative and the believing compre- hension about the unity between the Mystery of God and the Event of Jesus Christ. According to Laruelle, Christ has not only raised human freedom beyond the essence and existence (...) of an absolute (and, therefore, the founding axioms of Philosophy that require a prior foundation of the founded); but Christ exhibits the absolute in his finite existence as fully actual. Second, even briefly, we will trace the theological-anthro- pological physiognomy of the Mystery of the Incarnation by means of an inquiry in its soteriological sense. In that sense, the first formal Christian theology is precious: the theology of the Fathers of the Church. So, we intend to point to the way in which Christian faith contributes to the clarification of the singular super-natural quality that defines human nature in its divine connaturality: possibility of always being more and better in the world. His legacy includes a valuable poetic work. These pages are interested in the theological spirit of one of his most critically admired English sonnets, Night and Death. However, in order to know that own faithful way in which (...) the author expresses in his poem the human questioning for hope in the face of the experience of darkness and death, it is necessary to first penetrate, even if only in a synthetic way, in his understanding and experiencing of the relationship between religion and church, instinct of reason and truth of faith. This leads us to better meet with the background that encourages the poetic expression of his sensitivity towards the beauty of the world and the way in which man can discover in it the call of divine transcendence. This study investigates the debt owed by contemporary theological anthropology to the philosophical anthropology of the first half of the twentieth century (considered in its interest in interpersonal character of human identity). It should be recognized that there was a fairly complex relationship between them: sometimes anthropology ended up in some way forgetting theology, sometimes theology was sustained by anthropology and, often, invited to self-criticism. Analyzing «pneumatological» anthropology (and its Christological roots) elaborated by Ferdinand Ebner (1882- 1931) helps theological anthropology (...) not to forget that its method of investigation has to clarify both sides of the analogy between God and man in order to fully integrate the «expressive» meaning of both logics: theo-logic and anthropo-logic. Christian existence is permanently faced with the challenge of streng- thening the affective link between the experience of Faith and the truth of Faith. This paper tries to face this challenge through a dialogue between that peculiar human cognitive force that is empathy, and the verification that this is precisely the epistemological focus in which Gospel hermeneutics updates the meaning and salvific transcendence of the Person of Christ (dead and risen) for the witness of any time who meets Him.

We argue that there is no tension between Reid's description of science and his claim that science is based on the principles of common sense. For Reid, science is rooted in common sense since it is based on the idea that fixed laws govern nature. This, however, does not contradict his view that the scientific notions of causation and explanation are fundamentally different from their common sense counterparts. After discussing these points, we dispute with Cobb's and Benbaji's interpretations of Reid's (...) views on causation and explanation. Finally, we present Reid's views from the perspective of the contemporary debate on scientific explanation. (shrink)

Tanto en su acepción sacra, que remite a una llamada trascendente, como en su concepción laica, que vincula el sentimiento de felicidad con la propia realización personal, la palabra vocación quiere indicar el modo adecuado que sigue el sujeto para desempeñarse con éxito en la vida. Quizá por ello, cuando se habla de vocación resuenan aquellos elementos que componen la identidad del (...) ser humano: corporeidad y espiritualidad, intimidad y relacionalidad, inteligencia y sensibilidad, conciencia y libertad, biografía personal e historia colectiva. El desencanto causado por la «liquidez» axioló­gica, la demagogia política, el pragmatis­mo económico, la incertidumbre eco­lógica, el narcisismo digital y la uniformidad cultural en los que parece haberse instalado la antropología del trashombre, urge a elaborar un nuevo modelo de orientación vocacional que enseñe a vivir desde la «autotrascendencia» y la «ultimidad personal», o sea, desde la alteridad, la relación, la libertad y el don. Si se identifica libertad con voluntad, se corre el riesgo de tomar a la primera como el único aspecto en que la voluntad se desenvuelve, es decir, considerar el querer como mera actualización de la libertad. Pero la libertad no es más que un aspecto parcial de la voluntad, un aspecto cualitativo del querer, pues el dinamismo de la voluntad procede de su naturaleza y no del hecho de la libertad del acto del querer. La relación entre la inteligencia y (...) la voluntad es lo que caracteriza al acto específicamente humano. Por ello, se impone el análisis de la reciprocidad de influencia de las dos facultades espirituales en su propia unidad viva y funcional, pues si bien el libre albedrío se identifica con el momento de la elección, la libertad recorre todo el acto humano. Puesto que la voluntad tiende naturalmente a lo que supone perfeccionamiento del hombre, la libertad debe fomentar en el caso concreto esa orientación natural de la voluntad, es decir, elevarla a la práctica en la realidad concreta. Que la libertad disponga de la posibilidad de obrar en contra o al margen de ella, es decir, de romper de alguna forma la orientación natural de la voluntad, violentándola y torciéndola, es un defecto y también una forma de esclavitud, pues el hombre cuando obra el mal peca actúa al margen de la razón, conduciéndose como si fuese movido por otro distinto de él mismo. La posibilidad de apartarse del bien no pertenece a la esencia y a la perfección de la libertad, pues ésta consiste en obrar según la razón, impulso propio de acuerdo con su naturaleza. Los dos planos o motivaciones determinantes en que se articula la voluntad, como son el querer natural y necesario y, además, el querer deliberado y libre, son imprescindibles para dar un enfoque correcto al problema de la libertad: pues lo importante es apreciar en la acción libre la parte que se debe a la naturaleza de la voluntad, dándose la libertad únicamente como posibilidad de poner por obra un acto volitivo de acuerdo o no con la orientación natural de aquélla. El interés de esta indagación se centra especialmente en la voluntad deliberada o amor electivo del Bien. Podrá comprobarse la armonía constitutiva que reina entre la intención del fin y la elección de los medios, tema central cuando se estudia la psicología y la filosofía moral de Santo Tomás de Aquino. Las siguientes páginas se deciden a favor de la distinción entre intención del fin -intentio finis- y elección de los medios -electio mediorum-, haciendo partícipe a la voluntad deliberada del último fin en concreto, es decir, de Dios, a través de la intención, salvando así el poder de autodeterminación de la voluntad hacia el fin último en concreto, con lo que se abren las puertas a la conducta moral del hombre. Santo Tomás enfoca el problema de la libertad sin excluir ninguno de los tres planos en los que se articula, como son el plano ontológico, el plano psicológico y el plano moral, ya que el hombre tiene el deber de realizar en cada momento el máximo de su libertad en orden al perfeccionamiento de su ser, en una costosa labor de autocreación y no de caprichosa elección. Así, pues, el mayor ejercicio de libertad humana está en decidirse por su último fin en concreto, es decir, por Dios, a través de una adecuada elección de medios y de una recta intención, pues el hombre, en tanto que criatura, procede de Dios, y en tanto que hombre, tiene su fin último en la glorificación de Dios, en un doble ritmo de procesión y de retorno, poniéndose así de manifiesto el carácter religioso de la moral. Es por ello que el problema de la libertad es, en último término, un problema metafísico, que consiste en el movimiento natural y deliberado de la persona humana hacia su plenitud. (shrink)

Resumen: Este artículo trata del método y su relación con la investigación educativa. El objetivo es analizar la relevancia del método en ciencias humanas y sociales, en especial, en educación. Para ello, dividimos este artículo en tres secciones: 1. ¿Hay método? 2. ¿Hay uno o varios métodos? 3. La discusión sobre el método en la investigación educativa. A la primera pregunta, respondemos que hay método. Respondemos a la segunda señalando la necesidad de adoptar un pluralismo metodológico. La tercera sección defiende (...) que las discusiones sobre el método de investigación educativa implican dimensiones ontológicas, epistemológicas y éticas que se han tornado críticas, y se hace una revisión de cada una de ellas. En el apartado conclusivo, sugerimos algunas vías para desanudar esos asuntos críticos en la investigación educativa.: This article deals with method and its relation to educational research. The objective is to analyze the relevance of method in human and social sciences, especially in education. To this end, we divide this article into three sections: 1. Is there a method? 2. Do young children have a teleological conception of the essence of natural kinds? We tested this by examining how the preservation or alteration of an animal’s purpose affected children’s persistence judgments (N = 40, ages 4 - 12, Mean Age = 7.04, 61% female). We found that even when surface-level features of an animal (e.g., a bee) were preserved, if the entity’s purpose changed (e.g., the bee now spins webs), children were more likely to categorize the entity as a member (...) of a different natural kind (e.g., a spider) and these effects were similar in magnitude to altering the surface-features of a natural kind. Our results suggest that we might view teleological properties as partially constitutive of the essence of natural kinds. (shrink)

From our everyday commuting to the gold medalist’s world-class performance, skillful actions are characterized by fine-grained, online agentive control. What is the proper explanation of such control? There are two traditional candidates: intellectualism explains skillful agentive control by reference to the agent’s propositional mental states; anti-intellectualism holds that propositional mental states or reflective processes are unnecessary since skillful action is fully accounted for by automatic coping processes. I examine the evidence for three psychological phenomena recently held to support anti-intellectualism and (...) argue that it supports neither traditional candidate, but an intermediate attention-control account, according to which the top-down, intention-directed control of attention is a necessary component of skillful action. Only this account recognizes both the role of automatic control in skilled action and the need for higher-order cognition to thread automatic processes together into a unified, skillful performance. This applies to bodily skillful action in general, from the world-class performance of experts to mundane, habitual action. The attention-control account stresses that, for intentions to play their role as top-down modulators of attention, agents must sustain the intention’s activation; hence, the need for reflecting throughout performance. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

Does self-control require willpower? The question cuts to the heart of a debate about whether self-control is identical with some psychological process internal to the agents or not. Noticeably absent from these debates is systematic evidence about the folk-psychological category of self-control. Here, we present the results of two behavioral studies (N = 296) that indicate the structure of everyday use of the concept. In Study 1, participants rated the degree to which different strategies to respond to motivational conflict exemplify (...) self-control. Participants distinguished between intra-psychic and externally-scaffolded strategies and judged that the former exemplified self-control more than the latter. In Study 2, participants provided various solutions to manage motivational conflict and rated their proposals on effectiveness. Participants produced substantially more intra-psychic strategies, rated them as more effective, and advised them at a higher rate than externally-scaffolded strategies. Taken together, these results suggest that while people recognize a plurality of strategies as genuine instances of self-control, purely internal exercises of self-control are considered more prototypical than their externally-scaffolded counterparts. This implies a hierarchical structure for the folk psychological category of self-control. The concept encompasses a variety of regulatory strategies and organizes these strategies along a hierarchical continuum, with purely intra-psychic strategies at the center and scaffolded strategies in the periphery. Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Researchers often claim that self-control is a skill. It is also often stated that self-control exertions are intentional actions. However, no account has yet been proposed of the skillful agency that makes self-control exertion possible, so our understanding of self-control remains incomplete. Here I propose the skill model of self-control, which accounts for skillful agency by tackling the guidance problem: how can agents transform their abstract and coarse-grained intentions into the highly context-sensitive, fine-grained control processes required to select, revise and (...) correct strategies during self-control exertion? The skill model borrows conceptual tools from ‘hierarchical models’ recently developed in the context of motor skills, and asserts that self-control crucially involves the ability to manage the implementation and monitoring of regulatory strategies as the self-control exercise unfolds. Skilled agents are able do this by means of flexible practical reasoning: a fast, context-sensitive type of deliberation that incorporates non-propositional representations into the formation and revision of the mixed-format intentions that structure self-control exertion. The literatures on implementation intentions and motivation framing offer corroborating evidence for the theory. As a surprising result, the skill of self-control that allows agents to overcome the contrary motivations they experience is self-effacing: instead of continuously honing this skill, expert agents replace it with a different one, which minimizes or prevents contrary motivations from arising in the first place. Thus, the more expert you are at self-control, the less likely you are to use it. (shrink)

Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

This book is conceived as an introductory text into the theory of syntactic and semantic information, and information flow.

From the local level to international politics, deliberation helps to increase mutual understanding and trust, in order to arrive at political decisions of high epistemic value and legitimacy. This book gives deliberation a dynamic dimension, analysing how levels of deliberation rise and fall in group discussions, and introducing the concept of 'deliberative transformative moments' and how they can be applied to deeply divided societies, where deliberation is most needed but also most difficult to work. Discussions between ex-guerrillas and ex-paramilitaries in (...) Colombia, Serbs and Bosnjaks in Bosnia-Herzegovina, and police officers and locals in Brazilian favelas are used as case studies, with participants addressing how peace can be attained in their countries. Allowing access to the records and transcripts of the discussions opens an opportunity for practitioners of conflict resolution to apply this research to their work in trouble spots of the world, creating a link between the theory and practice of deliberation. The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. The bridges of Königsberg case has been widely cited in recent philosophical discussions on scientific explanation as a potential example of a structural explanation of a physical phenomenon. However, when discussing this case, different authors have focused on two different versions, depending on what they take the explanandum to be. In one version, the explanandum is the _failure_ of a given individual in performing an Eulerian walk over the bridge system. In the other version, the explanandum is the _impossibility_ of (...) performing an Eulerian walk over the bridges. The goal of this paper is to show that only the latter version amounts to a real case of a structural explanation. I will also suggest how to fix the first version, and show how my remarks apply to other purported cases of structural explanations. (shrink)

The central aim of the present investigation is to shed light on Nietzsche’s understanding of happiness and a good life, starting from Nietzsche’s appropriation of Plato’s and Aristotle’s doctrine of a hierarchy of human beings and forms of life.

In this paper I defend an intermediate position between the ‘bare mathematical results’ view and the ‘transmission’ view of mathematical explanations of physical phenomena (MEPPs). I argue that, in MEPPs, it is not enough to deduce the explanandum from the generalizations cited in the explanans. Rather, we must add information regarding why those generalizations obtain. However, I also argue that it is not necessary to provide explanatory proofs of the mathematical theorems that represent those generalizations. Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. If the universality of identity holds, then composition as identity not (...) only leads us to universalism, but also leads to the view that there are no mereological atoms. (shrink)

In “Willpower with and without effort”, G. Ainslie advances our understanding of selfcontrol by theoretically unifying multiple forms of willpower. But one crucial question remains unanswered: How do agents pick the right forms of willpower in each situation? I argue that willpower requires tactical skill, which detects willpower-demanding contexts, selects context-appropriate tactics, and monitors their implementation. Research on tactical skill will significantly advance our understanding of willpower.

Habitual action would still be a tremendously pervasive feature of our agency. And yet, references to habitual action have been marginal at best in contemporary philosophy of action. This neglect is due, at least, to the combination of two ideas. The first is a widespread view of habit as entirely automatic, inflexible, and irresponsive to reasons. The second is philosophy of action’s tendency (dominant at least since Anscombe and Davidson) to focus on explaining action by reference to reasons. Arguably, if (...) habitual behavior is reasons-irresponsive, and if action is explained by reference to reasons, the study of habit would have very little to teach about action. Recently, however, there has been a surge in philosophical interest on habit and habitual action. Novel approaches are challenging the two ideas mentioned above, arguing that (1) habitual behavior is not entirely automatic or inflexible, but instead has a particular kind of flexibility and intentionality; and that (2) acting out of habit can count as a form of acting for reasons, even in the absence of the traditional rationalizing mental states: belief, desire, and intention. -/- The essays contained in this issue move discussions forward in exciting new directions. In what follows we present each paper and situate it within its broader theoretical context, so that this introduction may serve also as an introduction to the topic of habitual action. A crucial lesson that emerges from these essays is a need to move past disputes between philosophical schools or traditions. Rather than combatting between different philosophical factions, an ecumenical approach capable of skillfully bringing together elements from different traditions seems better able to tackle problems that remain unsolved. These problems include (but are not limited to): developing an account of responsibility for habitual action; explaining our ability to perform joint habitual actions; and clarifying the link between habit and self-control. Die Forschung hat bislang entweder bemängelt, dass Nietzsches Philosophie ein Begriff von szialer Gerechtigkeit fehlt oder had einen solchen kaum in den Blick bekommen. Im Gegensatz dazu argumentiert der Aufsatz dafür, dass der sozialen Gerechtigkeit in Nietzsches politischem Denken eine zentrale Rolle zukommt. Er zeigt, dass das antike Vorbild seiner Gerechtigkeitsauffasseng Platons Begriff der politischen Gerechrigkeit ist. An additional thesis concerns the anthropological basis of what Nietzsche holds to be a just social order. The paper argues against a commitment to metaphysical necessity, semantic modalities are enough. The best approaches to elucidate the semantic modalities are (still) versions of lingustic ersatzism and fictionalism, even if only developed in parts. Within these necessary properties and the difference between natural and semantic laws can be accounted for. The proper background theory for this is an updated version of Logical Empiricism, which is congenial to recent trends in Structural Realism. The anti-metaphysical attitude of Logical Empiricism deserves revitalization. (...) La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

The two main theories of perceptual reasons in contemporary epistemology can be called Phenomenalism and Factualism. According to Phenomenalism, perceptual reasons are facts about experiences conceived of as phenomenal states, i.e., states individuated by phenomenal character, by what it’s like to be in them. According to Factualism, perceptual reasons are instead facts about the external objects perceived. The main problem with Factualism is that it struggles with bad cases: cases where perceived objects are not what they appear or where there (...) is no perceived object at all. The main problem with Phenomenalism is that it struggles with good cases: cases where everything is perfectly normal and the external object is correctly perceived, so that one’s perceptual beliefs are knowledge. In this paper we show that there is a theory of perceptual reasons that avoids the problems for Factualism and Phenomenalism. We call this view Propositionalism. We use ‘proposition’ broadly to mean the entities that are contents of beliefs and other doxastic attitudes. The key to finding a middle ground between Phenomenalism and Factualism, we claim, is to allow our reasons to be false in bad cases. Despite being false, they are about the external world, not our phenomenal states. (shrink)

Effort and the feeling of effort play important roles in many theoretical discussions, from perception to self-control and free will, from the nature of ownership to the nature of desert and achievement. A crucial, overlooked distinction within the philosophical and scientific literatures is the distinction between theories that seek to explain effort and theories that seek to explain the feeling of effort. Lacking a clear distinction between these two phenomena makes the literature hard to navigate. To advance in the unification (...) and development of this area, this article provides an overview of the main theories of the nature of effort and the nature of the feeling of effort, and then discusses how efforts and their feelings are related. Two key takeaways emerge. First, there is widespread agreement that efforts are goal-directed actions. Second, one of the main philosophical issues to be decided is whether feelings of effort should be defined by reference to efforts (effort-first approach), or whether efforts are defined by reference to the feeling of effort (feeling-first approach). La premisa que guía nuestra investigación es que Poética es un tratado científico, i. e., que la investigación desarrollada en dicha obra se corresponde con el examen de una téchne. Defendemos que el método utilizado se corresponde con el método general de investigación denominado “salvar las apariencias”. Tal método es expuesto con más detalle en otras obras del corpus pero lo presuponemos utilizado en Poética. Si bien el método presupone la recolección de datos, no se limita a eso puesto que (...) el paso ulterior consiste en la caracterización de las diferencias y la exposición de las cuatro causas del fenómeno. Aristóteles establece los principios de la generación en GC 1 pero en adelante construye genuinas demostraciones científicas apoyándose precisamente en aquellos principios. Reconstruiremos un pasaje puntual de GC 2. 10 para defender la hipótesis del uso real de la demostración científica en los tratados científicos. La particularidad específica de este trabajo es que esta demostración científica apunta a hacer explícita, (...) dentro del marco de la cuádruple causalidad aristotélica, la causalidad eficiente del fenómeno de la generación. The following considerations concern modelling Belief Dynamics (BD) not just in the sense of a formalization, but rather in the sense of building a computational model and implementing the corresponding data structures and algorithms of recomputing beliefs. The purpose of such a project is to illustrate some ideas about belief changes in a Web of Beliefs (WoB) to explore and deepen one's understanding of belief changes by trying to implement or improve corresponding algorithms.

Sophists and rhetoricians like Gorgias are often accused of disregarding truth and rationality: their speeches seem to aim only at effective persuasion, and be constrained by nothing but persuasiveness itself. In his extant texts Gorgias claims that language does not represent external objects or communicate internal states, but merely generates behavioural responses in people. It has been argued that this perspective erodes the possibility of rationally assessing speeches by making persuasiveness the only norm, and persuasive power the only virtue, of (...) speech. Against this view, I show how Gorgias’ texts support a robust normativity of language that goes well beyond persuasion while remaining non-representational. Gorgias’ claims that a speech can be persuasive and false, or true and unpersuasive, reveal pragmatic, epistemic, and agonistic constraints on the validity of speech that are neither representational nor reducible to sheer persuasiveness. In group discussions of any kind there tends to be an up and down in the level of deliberation. To capture this dynamic we coined the concept of Deliberative Transformative Moments (DTM). In deeply divided societies deliberation is particularly important in order to arrive at peace and stability, but deliberation is also very difficult to be attained. Therefore, we wanted to learn about the conditions that in group discussions across the deep divisions of such societies help deliberation. We organized such (...) group discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Srebrenica, and poor residents and local police officers in the favelas (slums) of Brazil. We could identify factors that help to transform discussions from low to high deliberation and risk transformations in the opposite direction. We could also identify factors that help to keep a discussion at a high level of deliberation, and, in a next step, we could determine to what extent long sequences of deliberation had a positive impact on the outcomes of the discussions. Finally, we show how our research results can have a long term effect if it is used in schools of such deeply divided societies. (shrink)

Justice Across Ages offers an attractive account of justice between the young and the old that brings together three notable principles of age-group justice: complete-lives equality, relational equality, and prudence. Yet, the book says little about the fact that many of us live longer than others, and the little it does say casts doubt on whether lifespan inequality threatens justice as construed by the three principles. This essay argues, instead, that theories of justice between the young and the old should (...) not dispense with a conception of justice between different longevity groups. It concludes that we must be sensitive to lifespan variations when designing policies to promote justice across age groups. (shrink)

Through modern driver assistant systems, algorithmic decisions already have a significant impact on the behavior of vehicles in everyday traffic. This will become even more prominent in the near future considering the development of autonomous driving functionality. The need to consider ethical principles in the design of such systems is generally acknowledged. However, scope, principles and strategies for their implementations are not yet clear. Most of the current discussions concentrate on situations of unavoidable crashes in which the life of human (...) beings is existentially affected. In this paper, we argue that ethical considerations should be mandatory for any algorithmic decision of autonomous vehicles, instead of a limitation to hazard situations. Such an ethically aligned behavior is relevant because autonomous vehicles, like any other traffic participants, operate in a shared public space, where every behavioral decision impacts the operational possibilities of others. These possibilities concern the fulfillment of a road-user’s safety, utility and comfort needs. We propose that, to operate ethically in such space, an autonomous vehicle will have to take its behavior decisions according to a just distribution of operational possibilities among all traffic participants. Using an application on a partially-autonomous prototype vehicle, we describe how to apply and implement concepts of distributive justice to the driving environment and demonstrate the impact on its behavior in comparison to an advanced but egoistic decision maker. In her last known piece of work Lady Mary Shepherd’s Metaphysics (1832), Mary Shepherd writes that “mind, may inhere in definite portions of matter […] or of infinite space” (LMSM 699). Shepherd thus suggests that a mind – a “capacity for sensation in general” (e.g., EPEU 16) – may have a spatial location. This is prima facie surprising given that she is committed to the view that the mind is unextended. In this paper, we argue that Shepherd can consistently honor (...) both of these commitments. We argue, first, that even though finite minds, due to their unextendedness cannot, to use Shepherd’s term, ‘occupy’ space as material bodies do, such minds can nonetheless be said to have a spatial location in virtue of what we call their presence, or what Shepherd calls ‘inherence’, in a material body. Second, we argue that, in a similar way, the divine mind is present throughout the whole of space and is thus omnipresent. We then argue that, in contrast to finite minds, the divine mind does not require a body to be present in space. Rather, we contend, God’s omnipresence might be best understood in a ‘holenmerist’ sense, where the divine mind is wholly present in every part of creation. (shrink)
